Are search engines illegal? محركات البحث هي غير قانونيه؟ The challenge of accessing copyrighted material under fair use and how it impacts our education. التحدي المتمثل في الحصول على المواد المحفوظه الحقوق في اطار الاستخدام العادل والكيفيه التي يؤثر بها التعليم لدينا.

Following the debate on وبعد المناقشه وعلي fair use الاستخدام العادل is a great way to dive into information economics. خطوة كبيرة نحو الغوص الى اقتصاد المعلومات. We all know and love that various kinds of media (audio, video, print…) are used to create songs, movies and books (or more generally “works”). ونحن جميعا نعرف ان الحب انواع مختلفة من وسائل الاعلام (السمعيه والبصريه ، وطباعه…) وتستخدم لخلق الأغاني والأفلام والكتب (أو أكثر بصفة عامة "تعمل"). These information creations are economically important as they are often targeted at a specific market for profit or at least sold to cover the costs of production. إبداعات هذه المعلومات اهمية اقتصادية حيث انها في الغالب تكون محددة تستهدف الربح في السوق للبيع او على الأقل لتغطية تكاليف الانتاج. Copyright law قانون حق المؤلف is designed to incent the creation of new works by legally restricting the ways in which we use them - for example I am allowed to quote a passage from a book I bought without getting permission, but I can’t photocopy large portions of the book to distribute them (without permission) since I might put the author out of a job - and that isn’t good for the creator or the consumer. incent يهدف الى خلق اعمال جديدة من قبل قانونا يقيد الطرق التي نستخدمها -- على سبيل المثال وانا على السماح لمرور اقتبس من كتاب اشتريت دون شرط الحصول على إذن ، ولكن لا استطيع تصوير اجزاء كبيرة من الكتاب توزعها (بدون اذن) وبما انني قد وضعت المؤلف من فرص العمل -- وهذا ليس جيدا بالنسبة الى المستهلك او الخالق.

Lawrence Lessig لورانس Lessig ’s engaging (as usual) 'اشراك (كالعاده) presentation on the Google Print debate عرض صور المطبوعه على المناقشه (now called “ (الذي يسمى الان " Google Book Search صور بحث الكتب “) makes an extremely interesting point: If Google either needs to obtain the permission of the rights holders before indexing their works or is not allowed to profit from such indexing , as the Author’s Guild and the publishers contend in separate lawsuits, then search engines are not a legal business model (since they index copyrighted content on the internet without permission and profit from their ability to provide links to that content in search results). This would be a pretty big deal indeed but please وهذا من شأنه أن تكون جميلة ولكن الواقع ان صفقة كبيرة من فضلك don’t panic لا تقلق - it would appear that Lessig has some compelling arguments why search engines such as this book search would fall under “fair use” which doesn’t require permission and can be the basis of profitable ventures . -- يبدو ان Lessig بعض الحجج الدامغه لماذا محركات البحث مثل هذا الكتاب بحث تندرج في اطار "الاستخدام العادل" الذي لا يحتاج الى إذن ويمكن ان تشكل اساسا للمشاريع مربحه. Fair use protects my ability to use small portions of a work for critical purposes, or create derivative works including parodies which are an important tool for social commentary. الاستخدام العادل يحمي بلدي القدرة على استخدام اجزاء صغيرة من عمل حاسم لاغراض او انشاء اعمال اشتقاقيه بما الباروديا التي هي اداة هامة لالاجتماعية التعليق. Fair use would allow me to publish من شأنه ان الاستخدام العادل واسمحوا لي ان ينشر some favorite quotations بعض الاقتباسات المفضلة . I’m no constitutional expert but I find it unlikely that democracy can work effectively without fair use since criticism relies on use of original materials for full effect. انا لا خبير دستوري ولكنني أجد أنه من غير المرجح ان الديمقراطيه يمكن العمل على نحو فعال دون الاستخدام العادل منذ النقد يعتمد على استخدام المواد الاصليه من اجل التنفيذ الكامل.
Therefore, assuming that the Google Book Search service will conform legally to the fair use doctrine as would appear to be the case, there is no reason to require Google to (1) obtain permission to include books (2) not profit from the service. ولذلك ، على افتراض ان صور الكتاب خدمة البحث من الناحية القانونية وسوف تتفق على مبدأ الاستخدام العادل وكما يبدو ان الأمر كذلك ، ليس هناك ما يدعو الى تحتاج الى صور (1) الحصول على اذن لتشمل كتب (2) لا يستفيدون من هذه الخدمة. The Author’s Guild and the Association of Publishers need to educate themselves before they create restrictions which both harm society and our ability to find the books we are looking for. صاحب البلاغ نقابه ورابطة الناشرين الحاجة الى تثقيف انفسهم قبل ان تخلق من القيود التي تضر المجتمع على حد سواء وقدرتنا على ايجاد الكتب التي نتطلع اليه.
